Everyone faces some form of discrimination throughout their lifetime and/or career. A person’s right to live a normal life should never be affected because of someone’s skewed view of other communities. Read on to learn more about the New York Human Rights Law (NYHRL).
NYHRL is state law that has been enacted to protect people from discrimination. These set of laws have made it illegal to discriminate against someone on the basis of age, race, creed, color, country of origin, sexual orientation, military status, gender, marital status or disability. Originally passed in 1945 as the Law Against Discrimination, the NYHRL was the first of its kind in the United States.
Bigotry and prejudices against selected groups of people should be discouraged to prevent discrimination from being rampant. By taking action against these people, we can send a message that discrimination is not welcomed in New York. Do not hesitate to contact your attorney if you believe you have been discriminated against.
First off, we would have to determine if there is sufficient evidence to suggest that the accused have discriminated against you. We also have to ascertain what protected traits you might have and the consequence of their discrimination.
Secondly, a demand letter would be made to the accused. This letter would outline the charges made against them and demands for these issues to be resolved. Once this issue has been resolved, we will work on your behalf to negotiate a settlement.
If unresolved, the subsequent step to take is to file your complaint. Once the complaint has been filed, the accused has up to 35 days to answer your complaint before discovery begins. Discovery can include interviews, documents and depositions that would help aid in the trial. Be prepared for thorough questioning from your attorney and the defense lawyers during the discovery process and resulting trial.
Common types of discrimination include harassment, sexual harassment, victimization and workplace discrimination. Discrimination can take place in any setting.
Under the NYHRL, it requires you to file the complaint within three years of the qualifying event. Contact your attorney immediately to discuss your claims once an incident has occurred.
Direct evidence and circumstantial evidence can be used against the accused. Some examples of evidence can include interviews, documents and videos.
NYHRL provides greater coverage for protected groups as compared to federal law. The NYHRL does this by encompassing additional protected groups and forbidding discrimination in more forms. Other policies are also in place in NYHRL to ensure that people are educated on their rights.
